Please ensure you have read, understood and agree to our terms and conditions before sending the booking form back to us. If you have any queries, please do not hesitate to contact us (hereafter called the Owner) for clarification before you complete the booking form.

Whilst we reserve the right to increase or decrease accommodation prices at any time, we will confirm to you the current price at the time of booking. As soon as you have confirmed your booking and paid your deposit or full payment, the cost of the rental is guaranteed against any further increase. This guarantee is offered subject to our terms and conditions and payment being adhered to and providing you do not make further amendments to your holiday arrangements.

Your holiday home rental includes Accommodation as booked, including services e.g. water and electricity. NOT included in our rental prices: a) Flights b) Car Hire c) Holiday Insurance.

Booking

The sending of the on-line booking form confirms your acceptance of the terms and conditions set out below and as may from time to time be changed and shall be binding on all persons stated on the booking form. Each booking will be confirmed by the owner, as soon as possible after receiving the booking form and deposit and only on receipt of this confirmation by you will the booking be treated as confirmed. Once the owners have confirmed the booking to you and you have paid a deposit, the named person on the booking form will be responsible for the total rental price of the property, as agreed on the confirmation. The remaining balance of the agreed rental cost must be paid 12 weeks prior to your departure. If the full balance of the rental cost is not paid as in accordance with these booking conditions, we reserve the right to cancel your booking and cancellation penalties will apply. PLEASE NOTE: Payment by credit card incurs a surcharge of 4.5%

Security Deposit

Our local management company thoroughly checks our inventory and cleans the property before your arrival and after you depart and will advise us of any faults or missing items. This includes such things as additional cleaning costs for removal of stains due to spillages, breakages or losses, and additional laundry costs. After you have vacated the property, our management company will wash one set of bedding from each bed used, plus all towels after departure (unless you have specifically requested otherwise), therefore any extra laundry left will incur an extra charge. We retain the right to retain the security deposit in full to cover damage or non- return of keys. Receipts for repairs / replacements or extra cleaning charges will be provided in the unlikely event that such retention of the security deposit is required. We strongly advise all of our guests to take a few minutes when they arrive to re-check the property for obvious damages, spillages etc. that may have been overlooked by the cleaning team. This ensures guests are not charged unnecessarily for damages/spillages etc. made by anyone else. In the unlikely event that you do find any problems please ensure you let the management company know about them as soon as possible! Full details of this can be found in the guest information file in the property. NOTE If damages are not reported on arrival we reserve the right to withhold part or all of your security deposit to recover these costs. Completion of the on-line booking form confirms your acceptance to pay for any damage of any kind caused by your occupancy of the property. The cost of repairs and/or replacements will be deducted from your security deposit prior to the return of the balance. The security deposit will be fully refundable 2-3 weeks after your departure from the property, providing there are no claims against it. In the event of any excess damage of any kind, excessive cleaning costs by our agents or excessive use of electricity (caused by leaving external doors or windows open with the air conditioning on) the named person on the booking form will be held responsible for all additional costs which exceed the security deposit. We reserve the right to pursue a guest for recompense for any and all damages caused which may exceed the value of the security deposit and will require payment within 14 days of being served notice of this.

Cancellations

Providing the owners receive written notice of cancellation not less than 12 weeks prior to the actual booking date, the signatory will not be liable to pay the full balance. It is the responsibility of the signatory to ensure that the signed cancellation letter reaches the owner. Email cancellations are not acceptable. The reservation deposit will be forfeited. If the cancellation is received after 12 weeks prior to the start of the holiday the signatory is liable to pay the full balance of the final invoice. If the owner is successful in re letting the property for all or part of the reservation period, the full balance or the part balance of the final invoice will be refunded. The owners reserve the right to cancel any bookings providing written notice is given and any balance paid refunded. In the unlikely event that circumstances beyond our control, necessitate cancellation of the booking, we will refund any monies paid to the party leader. (Without interest, compensation or consequential loss of any kind). Our management company will always seek to relocate your booking to an accommodation of a similar or superior standard.

Responsibilities

All persons stated on the booking form are responsible for the care of the property and are expected to take reasonable care of it including the locking of all doors and windows, ensuring the security alarm is activated whenever the property is unoccupied. At the end of the rental period, all utensils, carpets, furnishings, wall surfaces, fittings etc. must be left clean and tidy. It is the guest's responsibility to notify the management company immediately of any sudden equipment failure so that reasonable action can be take to rectify the situation. The maximum capacity for which our villa is licensed for is 8 persons. Everyone occupying the property must be listed on the booking form, including small children. As your party size will have been reflected in the quoted price, any increase in numbers must be reported to us prior to occupation - this is Florida state law and must be adhered to. The accommodations cannot be shared or sub-let and only the persons shown on the booking form are permitted to stay in the property. No pets are permitted. All ‘single sex’ parties or parties of guests who are under the age of 21 will only be accepted with prior written agreement from the owners. The owners reserve the right to refuse admittance if this condition is not met, failure to comply will render the booking void and no compensation payments will be paid. The property is fully licensed for short-term rentals in Florida.

Security Alarm

The villa has been fitted with an alarm system for your and our protection so we strongly advise you to use this during your stay. The system is fully monitored by the Brinks control center, should the alarm be triggered the control center will call the villa for confirmation of the security password – should this not be available – then the State Police will be alerted of a possible break-in and will attend the property. Please note – the State Police may charge the renter/householder for false alarms. Failure to use the alarm may invalidate your holiday insurance in the event of a claim. Full instructions for the alarm and code will be given prior to your stay.

Pest Control

Florida has a sub tropical climate and care must be taken with food that is left uncovered. Uncovered food will attract insects very quickly. Any added cost for pest control services incurred for lack of care may be passed to you. Dispose of leftover food, where possible in the waste disposal unit provided. Any food that cannot be disposed of should be put in the sealed outdoor bin located in the garage. Our management company will inform you of the regular garbage collection times.

Pool Safety

The pool area is fitted with a removable child safety fence and the poolside doors are alarmed also as an extra safety measure. Pool Rules/Spa Rules safety notices are displayed around the pool area for your reference and must be adhered to at all times. The swimming pool is used entirely at the guest’s own risk. Diving in the pool at any depth is not permitted. Running around the pool deck is not permitted. Children must be supervised at all times whilst in the pool area and in the villa. Glassware is not permitted in the pool area, so plastic alternatives have been provided for use around the pool area. If it is confirmed to us by our management company that glass has been broken in the pool area, we reserve the right to use your security deposit to cover this cost. Draining and cleaning the pool area is a long and expensive process so will most certainly take up all of your security deposit.

Smoking/Pets

For the comfort of guests the property is strictly non smoking accommodation. The accommodation is strictly a non-smoking area. We reserve the right to retain the security deposit if our management company confirms to us that smoking has taken place within the property. Half of the money retained will go towards redecoration and half will be donated to a Cancer Research UK.

Liability

The owners and the management company of the property accept no responsibility whatsoever for death, personal injury, accidents, loss or damage to persons or personal belongings however caused. The use of all accommodations and amenities including the pool is entirely at the user's own risk. Children must be supervised by responsible adults at all times when using the pool. Glass or crockery is not permitted within the pool area. The owners or management company cannot accept any liability for any loss of rental time due to travel problem, flight delays or cancellations, industrial disputes or any events outside our control, including any form of Force Majeure. The owners and the Management Company cannot accept responsibility for the sudden failure of villa equipment but will take immediate reasonable action to rectify any such failure upon notification by the guests. If the pool heater cannot reach optimum temperature due to adverse cold weather conditions the owners or the management company cannot accept liability.

Rental Period

• Midweek bookings may incur a 10% surcharge. • Stays of less than 7 nights will incur a cleaning fee which has been included in your quoted price. • The accommodation is available for occupation from 4.00pm local time on day of arrival and it is to be vacated before 10.30 am on the morning of departure unless otherwise agreed* *Late Checkouts/Early Check ins. An earlier check in or a later checkout may be arranged if absolutely required, but only when prior arrangement has been confirmed by the owner. If a late checkout/early check in has NOT been agreed or exceeds the prior arranged time then you will incur an extra charge which will be taken from your security deposit.

Insurance

It is a condition of the booking that all members of the Party are covered by travel insurance which carries adequate protection against delays and cancellations, and has adequate medical insurance for the USA, and for your luggage and personal belongings.

Force Majeure

The owner or the management company accept no responsibility whatsoever and no compensation or any other payment will be made if any cancellation or change to the terms of the booking becomes necessary due to war or threat of war, riots, civil commotion, terrorist activities, industrial disputes, natural and nuclear disasters, fire, flood, adverse weather conditions, building or construction in progress within the community, technical problems with transportation, closure or congestion of airports, alterations or cancellation of schedules by carriers, or any other events beyond our control.

Commitment from Homeowner and Management Company

The Homeowner and Homeowner's Management Company (MC) commit to keeping the property in its normal, safe, useable and habitable condition. In the event that the property is rendered unsafe, not usable or habitable by the local authorities and it is not caused by the guest’s actions, the guest shall immediately be relieved of its obligations under this agreement. They shall be refunded the unused portion of its rent and deposit. In the event of failure of equipment to work, please notify the MC and repairs/replacements will be made. The guest, however expressly waives and relinquishes any rights or claims against the owner or MC or agent for any damage that may result to guest from lack of maintenance, repair, or defect, including homeowner’s or MC or agents ordinary negligence. All personal property of the guest kept on the premises is at the risk of the guest. There will be no refund of all or part of the rental amount for any failure of any of the equipment to work. The only exception is the pool heat which would be refunded on a pro rata basis. No refund can be made for inclement weather, water temperatures that are above 82 degrees nor for days when the pool was not in use. Please do not attempt to adjust the pool heating yourself as it is very easy to damage and very expensive to fix. If we are notified that the pool heater has been tampered with, then we reserve the right to retain your security deposit to cover the repair costs.

Disclaimer

• LIABILITY – The property is privately owned and neither the owners nor the management personnel accept any responsibility whatsoever for personal injury, accidents, loss or damage to persons or personal effects, however caused. • The owners and their agents reserve the right of entry at any time. (This includes such workers as pool maintenance, gardeners etc). • Brochure description: whilst all information supplied in the website is deemed to be correct to the best of our knowledge, it is understood that the information supplied is for guidance purposes only and does not form any part of contract.

Law

This contract is subject to and shall be constructed in accordance with the laws of United Kingdom and Northern Ireland and the parties hereby submit to the exclusive jurisdiction of the English courts. It is strongly recommended that guests take out Holiday Insurance to cover cancellation fees and any other losses which may occur. Any claims for compensation, loss or injury must be directed to your Insurance company and will not be entertained by the Owner or their agents.

Code of Conduct

Tuscan Hills, Davenport is a residential community. The actions of all members of your party should not interfere with the enjoyment of either other holidaymakers or the residents of Tuscan Hills. Please do not use the swimming pool, play loud music or engage in any activity which may cause inconvenience to your neighbors after 10.30pm or before 07.30am. In the event that any member of your party behaves in a way that is likely to cause distress, danger or annoyance to any other holidaymakers, residents of Tuscan Hills or damage to any property, the owners or their management company reserve the right to terminate your rental agreement immediately and forthwith. The owners or their management company will not be liable for any costs you will incur, nor shall we pay any compensation, nor make any refunds due to this action.

Complaints

Your satisfaction with our accommodation is paramount to us so in the unlikely event of a problem or complaint during your stay (relating to our property) you should immediately contact our management company who will seek to resolve the matter speedily. Any complaints or correspondences received after your stay will not be entertained.
